Kanganis v. King, 244 A.D.3d 1124 (2d Dept. 2025)

The Appellate Division adopted Mr. Arazoza's arguments in affirming the decision of the Nassau County Family Court to dismiss a petition to modify custody wherein the opposing litigant failed to present allegations sufficient to warrant a change in circumstances.

Chiarello v. Chiarello, 214 A.D.3d 853, 185 N.Y.S.3d 307 (2d Dept. 2023)

The Appellate Division confirmed that the award of counsel fees to Mr. Arazoza’s client in the amount of $20,000.00 was appropriate under the circumstances of the case.

Sabatino v. Alagona, 214 A.D.3d 664, 182 N.Y.S.3d 917 (2d Dept. 2023)

In a Family Offense proceeding, the Appellate Division agreed with Mr. Arazoza’s arguments by holding that a motion to dismiss a family offense may be granted where the petitioner has failed to outline the occurrence of a family offense, even after being given every favorable inference.

Roberts v. Roberts, 212 A.D.3d 672, 182 N.Y.S.3d 701 (2d Dept. 2023)

The Appellate Division affirmed the decision of the Suffolk County Supreme Court granting Mr. Arazoza’s client summary judgment and directed that a commercial building and real estate holding company had to be liquidated and the proceeds paid to a trust under the control of his client.

Forman v. Forman, 211 A.D.3d 698, 179 N.Y.S.3d 718 (2d Dept. 2022)

The Appellate Division held that the Suffolk County Supreme Court properly denied the Wife’s motion to vacate her divorce stipulation of settlement, agreeing with Mr. Arazoza’s argument that the Wife had accepted the benefit of that agreement and had thus ratified its terms by collecting over a million dollars from her husband before challenging the agreement’s validity by claiming the terms of that agreement were unfair to her.

Murphy v. Murphy, 175 A.D.3d 1540 (2d Dept. 2019)

In another remarkable case in 2019, Mr. Arazoza appeared before the Appellate Division, Second Department, where he successfully secured substantial spousal maintenance for his client, a forty-two-year-old woman, until her sixty-seventh birthday, amounting to $10,760 per month.

Cook v. Cook, 162 A.D.3d 674 (2d Dept. 2016)

Wherein Mr. Arazoza skillfully persuaded the Appellate Division to modify the Suffolk County Supreme Court’s trial decision, leading to the transfer of custody of both children from the Mother to the Father as the Court found that the Father was more sensitive to the needs of the children.

Prince v. Prince, 134 A.D.3d 1008 (2d Dept. 2015)

The Appellate Division, adopting Mr. Arazoza’s arguments, affirmed the decision of the Nassau County Supreme Court which denied an attorney’s request for a judge to recuse himself from a case based on the allegation that the judge was biased against that attorney.
